Christine’s Claim for Back Injury Compensation
We helped Christine gain full compensation for a back injury which she suffered when she slipped on black ice at a local petrol station.Christine worked as a self-employed Podiatrist. One winter’s day she went to her local service station to fill up the car with petrol. Christine slipped on a large pool of black ice as she got out of her car. The ice was adjacent to the petrol pump where lots of people walk and she had not noticed it when she drove onto the forecourt. There were no warnings on the site so she wasn’t prepared for the slippery conditions.
After the injury, we learned that this particular service station often suffered from black ice deposits. Christine contacted our Personal Injury team to ask if we could help her claim compensation for a back injury of this sort. We were pleased to say that we could help.
Investigations and Claim for the Back Injury
We investigated and we found that the garage’s housekeeping systems did not take account of the risk of black ice. After the accident Christine suffered with ongoing back problems. We pursued Court proceedings on her behalf following which the garage owners accepted responsibility for her injuries. We also persuaded them to offer Christine rehabilitation. This was very important to her as it helped her to return to work as speedily as possible.
It was also important for us to obtain expert medical evidence to substantiate the extent of her injuries. Initially the garage’s insurer’s experts tried to suggest that Christine’s injuries were all in existence before the accident. They said her injuries had merely been made worse by it. We carefully examined Christine’s medical history and spoke to our own medical experts. As a result we were able to refute these suggestions so that Christine was able to recover full compensation for the effects of the accident.
